MotionQL

Draft: this document is being finalized and may change before MotionQL's public release.

MotionQL Acceptable Use Policy

Effective [EFFECTIVE DATE]

This Acceptable Use Policy ("AUP") applies to your use of the MotionQL desktop app, the MotionQL Team Server, our website at https://motionql.com, and our support channels (together, the "Services"), provided by Shoval Real Estate Holdings LLC ("we"). It forms part of the EULA and the Terms of Service.

MotionQL is a tool for working with databases you are authorized to use. Most of this policy is about using it for that purpose and not against other people's systems.

1. Authorized access only

You must not use the Services to:

  1. access, query, copy, modify or delete data in any database, server or system you are not authorized to access, or exceed the access you have been granted;
  2. scan, probe or test the security of systems you do not own or have written permission to test;
  3. bypass authentication, access controls, rate limits or other security measures of any system, including by using stolen or guessed credentials;
  4. use SSH tunnels, proxies or jump hosts to reach networks you are not permitted to reach.

2. Lawful use of data

You must not use the Services to:

  1. process personal data without a lawful basis, or in breach of data protection, privacy, consumer or employment laws;
  2. collect, extract or export personal data in order to sell it, to stalk or harass people, or for unlawful surveillance or profiling;
  3. store, process or distribute content that is illegal, infringes intellectual property rights, or exploits children;
  4. violate export control or sanctions laws.

3. AI features

When you use AI features, you must also:

  1. comply with the terms and acceptable use policies of the AI provider you configure;
  2. make sure your organization allows sending the information described in the Privacy Policy to that provider;
  3. review AI-generated queries, pipelines, index changes and mask rules before running them, especially against production data.

4. Protecting the Services

You must not:

  1. circumvent license verification, the trial period, or enterprise policy enforcement, or share License Keys;
  2. interfere with or disrupt the Website or any hosted service, including by denial-of-service attacks, excessive automated requests, or introducing malware;
  3. attempt to access other customers' accounts or data;
  4. use the Services to send spam or unsolicited communications;
  5. misrepresent your identity or affiliation when dealing with us.

5. Security research

We welcome good-faith security research on MotionQL itself. Please follow our Security Policy, which explains what is in scope and how to report. Research that follows that policy is not a breach of this AUP.

6. Reporting and enforcement

Report suspected violations to abuse@motionql.com. If we reasonably believe you have violated this AUP, we may, depending on the seriousness: ask you to stop, suspend your account, support or License Key, terminate your license under the EULA, and report unlawful activity to the appropriate authorities. We will give notice where reasonable and lawful.

Because the desktop app and the Team Server run on your infrastructure, we cannot and do not monitor how you use them. Your organization's administrators are responsible for monitoring its own use, for example with the local audit log and the Team Server audit log.

7. Changes

We may update this AUP. The effective date above shows when it was last changed.
